Terms & Conditions
The Client and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible outcome within the understanding of the contract.PAYMENT
A non-refundable deposit of £150 for a single photography session must be paid for at the time of booking to secure your session date. The deposit can be paid directly via the website’s booking form when securing a session date. If booking via phone or email, the Photographer will send you an invoice.
*For newborn sessions only: Due to the uncertain prediction of the exact arrival day of your baby, certain flexibility for booking the newborn session will apply. The initial date of your due date is to be pencil-booked in, however, this is subject to change depending on the exact date of birth. Once agreed upon an initial session date, you may reschedule your session up to 10 days prior to your shoot if required.
CANCELLATION
The deposit is non-refundable in the event of the Client canceling the session for whatever reason (N.B. see SICKNESS below for exceptions). It will be considered as liquidated damages to the Photographer and retained to cover the loss of bookings for that date. This is enforceable even if this contract hasn’t been signed – purchasing the session is entering into a contract of sale.
Please note that for mini sessions (Christmas, Easter, etc.) the fee is non-refundable. In the event of a no-show or cancelation after the session has been scheduled, no refund will be made to you. If you need to reschedule your sessions, please provide at least forty-eight (48) hours advance notice of same, your session fee may be applied to the next mini-session event (date to be determined).
SICKNESS
Children can be unpredictable and fall ill at any time. In the event of sickness prior to the session, the Client agrees to make every possible effort to inform the Photographer no later than 2 hours prior to the start time of the photography session. The session can be rescheduled at the convenience of both parties within a maximum 2-month period. If the Client fails to reschedule within the 2-month time period, the Photographer has the right to cancel the booking altogether and the deposit paid prior to the session becomes non-refundable. In the event of inability to reschedule the session during 2-month period due to prolonged sickness or more serious health complications the deposit will be refunded with appropriate medical evidence.
In the event of the child falling ill during the session, the Photographer reserves the right to postpone the photoshoot and re-schedule at the convenience of both parties.
EDITING
The Photographer has the exclusive right to select and edit the photographs that she feels best to reflect her style and quality of work. During the image selection process, any photographs that are not suitable for selection are discarded, and under no circumstances are they available to the client. During the viewing session, the client can request additional editing only of small details personal to the client such as removing scars, birthmarks, etc. The RAW images remain the property of the photographer and cannot be transferred to the client, nor they can be purchased.
DELIVERY
Editing time after the session can be up to 3 weeks. The client then gets an invitation for a viewing and ordering sessions. Delivery for prints, albums, or any other additional orders may vary and will be advised during the viewing session.
Fragile and large items such as wall art must be collected in person by the client. Once the item has been collected, the Photographer cannot take any responsibility or liability for any damage to the product during the transportation from the photographer’s studio to the client’s final destination. However, the Photographer will provide the safest and most appropriate packaging for the item’s transportation.
PRINTS
All orders for albums, reprints, products, and enlargements must be paid for at the time of ordering. The delivery of prints may take up to 4 weeks.
The Photographer uses only professional private labs to guarantee the quality of prints. These labs calibrate their printers to our high standard of editing processes.
The Client has no obligation to order prints or products through the Photographer using the images provided. However, the Photographer will not be liable or responsible for the colour balance or quality of any prints reproduced in Third Party Printers, such as High Street Photo processing and/or home printing devices.
All orders for albums, prints, products, and enlargements must be paid for at the time of ordering. The delivery of prints may take up to 4 weeks.
DIGITAL PRODUCTS (USB)
The Photographer encourages the Client to make a backup of all digital media provided by the Photographer on an external hard drive or any digital storing place. The Photographer cannot be held responsible for the loss or damage of the USB/digital images provided in the package.
COPYRIGHT
The copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication, or any Commercial use of the photographs is not allowed without prior written permission from the Photographer. Alternation of any images handed to the Client is strictly forbidden by anyone other than the original photographer. The Client may not pass copies of any images to any other professionals without the prior consent of the Photographer, and then if permission is granted only a watermarked version of the files can be shared and the said professionals must link back to www.mumdadandme.photography
SALE/OFFERS
The Photographer reserves the right to reduce the cost of sessions or digital files at times throughout the year as an “offer” or “sale”. If you have paid full price for a session or digital files at another date, it is not possible to then receive the discounted price for items previously purchased at an earlier date, this includes (but is not limited to) gift vouchers and advance bookings.
MISC
Although the photographer shall exercise all reasonable skill, care, and diligence in the discharge of her duties, it is understood that, in the event of any unforeseen circumstances causing loss of photographic record, the photographer will only be responsible for the return of all the money paid to date, although every effort will be made to re-take the photographs.
